Event: Bankruptcy > Motions/Applications > Continue Hearing

For Final Hearing or Trial

If a party is unable to attend a scheduled hearing, they may request a continuance or adjournment.

Filing Requirements:

  • Motion to Continue/Adjourn Hearing
  • Affidavit stating reason for adjournment request (OR the reason may be stated in the Motion)
  • Proposed Order

The Judge will either direct a hearing to be set on the motion, or sign the proposed Order. If the Judge signs the Order, then the matter can be adjourned.

For Preliminary Hearings Set by Clerk's Office

Filing Requirements:

  • Stipulation to Adjourn a Preliminary Hearing (ONLY applicable to Preliminary Hearings set by the Clerk's Office)
    OR
  • Parties may call the Clerk's Office to request to adjourn a Preliminary hearing if all sides agree to the adjournment.

To File Electronically:

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Motions/Applications].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Continue Hearing] from the event list.
  5. Select the party filer.
  6. Browse to select the Motion (.pdf file).
    Note: Supporting documents and the Proof of Service may be added as attachments to this document.
  7. Modify the text as appropriate.
  8. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
  9. Electronically file the Proposed Order.
