An eligible creditor can file a supplmental claim in a Chapter 13 Case. The CARES Act includes a provision that allows borrowers experiencing a financial hardhip due to COVID-19 to request a forbearance on their mortgages. This claim can be filed even if the claim's bar date has passed.
This event:
- Supplements the claim on the cocket and claims register
- Is not an attachment to the claim
- Is not an amended claim
- Is filed as a claims event
Filing Requirements:
- Form 4100S Supplemental Proof of Claim for CARES Forearance Claim
- Proof fo Service
To File Electronically:
- Log into CM/ECF.
- Select [Bankruptcy > Claim Actions OR Creditor Claim Actions].
- Enter the case number (e.g, xx-xxxxx).
- Select [Supplmental Proof of Claim for CARES Forbearance Claim)] from the event list.
- Select the party filer. If the party is not listed, click on Add/Create New Party.
Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association. - Browse to select the Notice (.pdf file).
- Select Claim from the list.
- Is a Proof of Service included or attached to the document currently being filed? (Yes or No)
- Modify the text as appropriate
- Verify the final docket text; if correct, click [Next] to submit your document(s).
