Event: Bankruptcy > Claim Actions OR Creditor Claim Actions > Notice of Mortgage Payment Change OR Notice of Mortgage Payment Change (No Proof of Claim Filed)

This event:

  • Supplements the claim on the claims register
  • Is not an attachment to the claim
  • Is not an amended claim
  • Is filed as a claims event

This Notice details late charges, NSF fees, attorney fees, courts costs and inspection fees that the debtor will be responsible for his principal residence.

Filing Requirements:

  • Form 410S1 Proof of Claim, Supplement 1- Notice is filed as a "supplement" to the claim
  • Proof of Service
    Note: Creditor will notify the debtor, debtor's attorney and trustee of any changes in the payment amount no later than 21 days before the new payment amount is due.

To File Electronically:

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Claim Actions OR Creditor Claim Actions].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Notice of Mortgage Payment Change OR Notice of Mortgage Payment Change (No Proof of Claim Filed)] from the event list.
  5. Select the party filer. If the party is not listed, click on Add/Create New Party.
    Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.
  6. Browse to select the Notice (.pdf file).
  7. Select Claim from list.
  8. Is a Proof of Service included or attached to the document currently being filed? (Yes or No)
  9. Modify the text as appropriate
  10. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
