Event: Adversary > Notices > Notice of Dismissal

The Plaintiff, for whatever reason, may decide that they do not wish to pursue the adversary proceeding. No court order is required if:

the complaint does not object to discharge (727);

no answer or motion for summary judgment has been filed;

a stipulation of dismissal, signed by all parties who have appeared has been filed.

Note: If the complaint objects to the debtor's discharge (727), or an answer or a motion for summary judgment has been filed, then the proceeding must be dismissed on court order. See instructions for Motion and Order to Dismiss.

Filing Requirements:

  • Notice of Dismissal
  • Proof of Service 

To File Electronically:

  1. Log into CM/ECF.
  2. Select [Adversary > Notices].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Notice of Dismissal] from the event list.
  5. Select the party filer.
  6. Browse to select the Notice of Dismissal (.pdf file).
    Note: Any supporting documents and the Proof of Service may be added as attachments to this document.
  7. Modify the text as appropriate.
  8. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
