Multi-part motions are motions that consist of more than one relief type. It is important to docket multi-part motions correctly as the Court is required by Bankruptcy Abuse Prevention & Consumer Protection Act of 2005 (BAPCPA) to report certain pleadings to Washington.

The following identifies which pleadings are required to be reported:

  • Reportable Events

If an attorney combines motion relief types, it is recommended to limit the number to two relief types, as there are different procedures, fees, etc. for the various motions. Also, ECF complicates the docketing process for combined events, making it challenging to determine which ECF prompt is intended for which relief type being filed.

Example of a Multi-Part Motion:

  • Motion for Relief from Stay or, in the Alternative, for Adequate Protection

To File Electronically

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Motions/Applications].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Relief from Stay]
    Note: Be sure to select the motion relief types in the same order as listed on caption of the multi-part motion (pdf) being filed.
  5. Select (ctrl + click) [Adequate Protection]
  6. Select the party filer. If the party is not listed, click on Add/Create New Party.
    Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.
  7. Browse to select the Motion (.pdf file).
    Note: The Motion, Notice of Motion, and Proof of Service may be a single pdf; or the Notice, supporting documents, and Proof of Service may be added as attachments to this document. The Motion must be the first document in your pdf.
  8. Enter the last day to object (defaults to 14 days; modify if necessary)
    Note: Remove this date if you are not filing a Notice at this time.
  9. To pay via credit card, leave the receipt field blank and select NEXT to continue filing.
    Note: If filing fee is exempt, type exempt in receipt field.
  10. Modify the text as appropriate. You may choose prefixes for the motions (see choices listed on drop-down boxes which precede the motions.) Also, select either "in addition to" or "or in the alternative" to bridge the motions.
  11. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
