Filing Requirements:

  • Modified Plan
    THE USE OF LOCAL FORM 3015-1.1 [CHAPTER 13 PLAN] IS MANDATORY FOR ALL CHAPTER 13 PLANS [initial, amended, and modified].
  • Chapter 13: Request to Modify Confirmed Chapter 13 Plan [Local Form 3015-1.3] or Request to Modify Confirmed Chapter 13 Plan Under U.S.C. 1329(d) (CARES Act)
    Note: The Request to Amend must be filed with the Amended Plan.
  • 21-day Notice of Modified Plan. Notice is sent to all creditors by the moving party. Rule 2002(a)(5)
  • Proof of Service
  • Chapter 11/12 cases: Proposed Order (may be filed after the last day to object has expired)
    When drafting the proposed order, include "... modified plan is confirmed ..." rather than “granted.”
    Note: Court will enter the order for Chapter 13 cases.

To File the Modified Plan Electronically:

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Plan].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Modified Plan (After Confirmation)] or [Modified Plan and Request to Modify Confirmed Chapter 13 Plan Under U.S.C. 1329(d) (CARES Act)] from the event list
  5. Select the party filer.
  6. Browse to select the Modified Plan (.pdf file).
    Note: The Request to Modify Confirmed Chapter 13 Plan, Notice, and Proof of Service may be added as attachments to this document.
  7. Select the chapter.
  8. If your Modified Plan relates to a previously filed Modified Plan that has NOT been approved by the Court, check the box to refer to the pending Modified Plan. Otherwise, click [NEXT] to continue.
  9. Enter the last day to object (defaults to 21 days; modify if necessary)
    Note: Remove this date if you are not filing a Notice at this time.
  10. Modify the text as appropriate.
  11. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
  12. If notice was not filed with Modified Plan, electronically file the notice of modified plan along with the proof of service. [Notices > Notice of Modified Plan]
