Filing Requirements:
- Application to Employ
- Verified Statement or Affidavit of the person being employed
- An attorney’s affidavit must state his/her connection to the debtor(s), the creditors, or any other person listed in Rule 2014, or an affirmative statement that there are no connections.
- Proposed Order
Language required on all Orders to Employ:- Until final approval of fees and expenses, any payment to [insert name here] remain subject to recoupment and disgorgement.
- [last paragraph] The Court shall retain jurisdiction to hear and determine all matters arising from the implementation of this Order.
To File Electronically:
- Log into CM/ECF.
- Select [Bankruptcy > Motions/Applications].
- Enter the case number (e.g, xx-xxxxx).
- Select [Employ] or [Employ (with 7-day notice)]from the event list.
Note: Select [Employ (with 7-day notice)] when a notice giving 7 days to object is included with the Application. - Select the party filer. If the party is not listed (e.g., Creditors' Committee), click on Add/Create New Party.
Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.
Note to Chapter 7 Trustee: When employing yourself as attorney for trustee, you must uncheck this box. -
Browse to select the Application to Employ (.pdf file).
Note: The Verified Statement/Affidavit and Proof of Service may be added as an attachment to this document. The Proposed Order must be filed separately using the Proposed Order event. - Enter the name of the person to be employed and enter the type of position when prompted.
- If you select [Employ (with 7-day notice)] from the event list, enter the last day to object (defaults to 7 days; modify if necessary).
- Modify the text as appropriate.
- Verify the final docket text; if correct, click [Next] to submit your document(s).
