Event: Bankruptcy/Adversary > Appeal > Other Orders > Notice of Appeal/Notice of Cross Appeal

An Appeal is a review by a higher court of the Judgment or Decision of a lower court.

A Notice of Appeal (Official Form 417A) must be filed with the Clerk of the Bankruptcy Court within 14-days of the date of the entry of the Order.

  • If a written Order is requested, or issued by the Court, the 14-days starts from the date of the entry of the written order.

To File Electronically:

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Appeal] OR [Adversary > Appeal].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Notice of Appeal] OR [Cross Notice of Appeal] from the event list.
  5. Select the party filer.
  6. Browse to select the Notice of Appeal (.pdf file).
    Note: The Proof of Service may be added as an attachment to this document.
  7. Check box to Refer to the Order being appealed.
  8. To pay via credit card, leave the receipt field blank and select NEXT to continue filing.
    Note: When filed by Trustee or Debtor in Possession, and the fee is deferred, enter "defer $293". Clerk's office will change amount paid to $5.00; then filer will pay via pay.gov. (Only the docketing fee of $293.00 is deferred).
  9. Modify the text as appropriate.
  10. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
