Notice of Dismissal by Plaintiff

The Plaintiff, for whatever reason, may decide that they do not wish to pursue the adversary proceeding. No court order is required if:
the complaint does not object to discharge (727);
no answer or motion for summary judgment has been filed;
a stipulation of dismissal, signed by all parties who have appeared has been filed.
Note: If the complaint objects to the debtor's discharge (727), or an answer or a motion for summary judgment has been filed, then the proceeding must be dismissed on court order. See instructions for Motion and Order to Dismiss.
Filing Requirements:
- Notice of Dismissal
- Proof of Service
To File Electronically:
- Log into CM/ECF.
- Select [Adversary > Notices].
- Enter the case number (e.g, xx-xxxxx).
- Select [Notice of Dismissal] from the event list.
- Select the party filer.

Browse to select the Notice of Dismissal (.pdf file).
Note: Any supporting documents and the Proof of Service may be added as attachments to this document. - Modify the text as appropriate.
- Verify the final docket text; if correct, click [Next] to submit your document(s).
