11 U.S.C. 1016

Event: Bankruptcy > Miscellaneous > Letter

The Court must be notified of the death of a debtor, or other party, with a pending bankruptcy case or matter that is, or will be, appealed.

For a deceased debtor, this can be done by a formal letter or reference of the death may be noted in a pleading filed with the Court. For parties to an Appeal, see Substitution of Parties.

To File Electronically:

  1. Scan the Letter/Document.
  2. Log into CM/ECF.
  3. Select [Bankruptcy>Miscellaneous].
  4. Enter the case number (e.g, xx-xxxxx).
  5. Select [Letter].
  6. Select the party filer.
  7. Browse to select the Letter/Document (.pdf file).
  8. Note that letter relates to the death of a debtor in the text box.
  9. Verify the final docket text; if correct, click [Next] to submit your document(s).

Note: The Notice of Electronic Filing displays giving you the document number. Copes of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
