After the Confirmation Hearing, the Court may confirm the plan as either:
(A) Consensual [1191(a) Consensual - No Objections to the Plan] or
(B) Non-Consensual [1191(b) Non-Consensual - Plan Confirmed Over Creditor's Objection]
Proposed Confirmation Order
Debtor / Debtor's Attorney will provide the Court with a proposed Order Confirming Chapter 11 Small Business SubV Plan.
⟡ Include language identifying whether the Confirmation is Consensual 1191(a) or Non-Consensual 1191(b).
- The order may be submitted before or after the confirmation hearing.
- Note: In some instances, the Court may enter their own order after the confirmation hearing.
Docket Proposed Confirmation Order
- Select [Bankruptcy > Miscellaneous].
- Enter the case number (e.g, xx-xxxxx).
- Select [Proposed Confirmation Order (Ch 11 Sub V Only)] from the event list.
- Select the party filer. If the party is not listed, click on Add/Create New Party.
Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association. - Enter the "Order to be signed on or after" date.
- Browse to select the Proposed Confirmation Order (.pdf file).
- The Upload a Single Order via docketing screen will appear; Click [Next].
- On the Upload a Single Order via docketing screen, enter the following:
- Order Type: Select Routine.
- Hearing date: Leave date blank.
- Select the appropriate radio button to indicate if the Plan is Consensual or Non-Consensual
- Verify the final docket text; if correct, click [Next] to submit your document(s).
Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
