Event: Bankruptcy > Motions/Applications > Compensation

Filing Requirements:

  • Application for Compensation
  • Notice of Application giving 21 days to object. Rule 2002(a)(6). Notice is sent to all creditors. Rule 2002(a)(6).
  • Note: If the Application is filed with Chapter 7 Trustee's Final Report, the Notice is generated by court through the BNC (Trustee's Notice of Chapter 7 Final Report).
    Note: Notice is not necessary if the amount requested does not exceed $1,000.00.
  • Proof of Service
  • Proposed Order (may be filed after the last day to object has expired)

    Chapter 11 cases: When drafting the proposed order, the following language must be added to an order that grants an interim fee application. "All payments made pursuant to this Order are subject to final review by the Court as part of a final fee application process at the close of this case, and any fees paid pursuant to this Order are subject to recoupment and disgorgement."

To File Electronically:

  1. Log into CM/ECF.
  2. Select [Bankruptcy > Motions/Applications].
  3. Enter the case number (e.g, xx-xxxxx).
  4. Select [Compensation] from the event list.
  5. Select the party filer (party requesting fees). If the party is not listed, click on Add/Create New Party. If the party requesting fees is the attorney for debtor, select debtor as the party filer.
    Note: The Attorney/Party Association screen may appear. Do not check this box to create an association.
  6. Browse to select the Application (.pdf file).
    Note: The Application, Notice of Application, and Proof of Service may be a single PDF or the Notice, supporting documents, and Proof of Service may be added as an attachment to this document. The Application must be the first document in your PDF.
  7. Enter the last day to object (defaults to 21 days; modify if necessary).
    Note: Remove this date if you are not filing a Notice at this time.
  8. Check the filer (party receiving the fees); select the type; enter dates from when, to when; and enter fees requested and expenses requested (i.e., 2000.00 and 125.00).
  9. Modify the text as appropriate.
  10. Verify the final docket text; if correct, click [Next] to submit your document(s).
    Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.
  11. Electronically file the Proposed Order. Instructions
